These Terms govern purchases made through our website and the use of our online services.
Scope of These Terms
These Terms apply to orders placed through www.swapandfit.com. By submitting an order, you agree to the contractual terms presented during checkout, to the extent that they form part of the purchase contract under applicable law.
Nothing in these Terms excludes or restricts any mandatory rights available to consumers under applicable German or European law.
Products and Product Information
We provide product descriptions, images, specifications, prices and other relevant information on the applicable product pages.
Customers should review the product details, dimensions, intended use and compatibility information before placing an order.
We take care when preparing product information and aim to describe the goods offered clearly and accurately. If goods do not conform to the purchase contract, the customer’s statutory rights remain unaffected.
Prices and Payment
Product prices, applicable taxes, delivery charges and other mandatory costs will be displayed as required before the order is submitted.
The total amount payable will be shown during checkout before the customer confirms the purchase.
Payment must be completed using an available payment method offered during checkout. An order may be subject to payment authorisation and order review before dispatch arrangements are finalised.
Where a genuine pricing or listing error occurs, we will address the matter in accordance with the applicable contract and law. If an order cannot be fulfilled on the agreed terms, we will contact the customer and arrange any refund required by law.
Orders and Contract Formation
Submitting an order constitutes an offer to purchase the selected goods under the terms shown during checkout.
An automated acknowledgement confirming receipt of an order does not necessarily constitute acceptance of the offer unless it expressly states otherwise.
The purchase contract is formed at the point specified in the checkout process or order confirmation.
Customers should check the selected products, quantities, delivery address and contact details before submitting an order.
If an order cannot be accepted, we will inform the customer and refund any amount collected where required.
Order Processing and Delivery
We serve customers across Europe and work with established delivery carriers, including DHL, FedEx and UPS Priority services, where available for the relevant destination and shipment.
Our standard transit estimate is 5–10 calendar days after dispatch. The applicable estimate and any relevant delivery information will be communicated during checkout or in the order confirmation.
Transit estimates are provided for planning purposes and do not replace any agreed delivery deadline or statutory delivery obligation.
We send shipment tracking notifications to the email address supplied at checkout at relevant stages, which may include dispatch, arrival at a carrier facility and local delivery updates, depending on the information made available by the carrier.
Customers are responsible for providing a valid email address and accurate delivery details. If an email address or delivery address needs to be corrected, please contact us promptly.
Delayed, Missing or Untracked Orders
If an order has not arrived within the stated delivery estimate, please contact us at promo@swapandfit.com and provide your order number.
We will review the shipment information and, where appropriate, contact the relevant carrier to investigate the delay or missing delivery.
Following the investigation, we will determine the appropriate resolution in accordance with the circumstances, the purchase contract and applicable law. Depending on the findings and the customer’s legal entitlements, this may include arranging a replacement shipment or issuing a refund.
Where a mandatory delivery deadline has been missed, the customer retains any remedies available under applicable law, including the right to set an additional reasonable period for delivery where required before terminating the contract.
We will not treat a shipment as successfully delivered solely because it has been handed to a carrier. For consumer purchases, the risk of loss or damage generally remains with us until the customer, or a third party designated by the customer other than the carrier, physically receives the goods, subject to applicable law.
Delivery Address and Receipt
Customers should ensure that the delivery address and contact information supplied during checkout are accurate and complete.
If a delivery attempt fails because the information supplied by the customer is incorrect or incomplete, we will review the circumstances and communicate with the customer to determine the appropriate next steps in accordance with applicable law.
Nothing in this section transfers the statutory risk of loss or damage to the customer before the goods are received where such a transfer is prohibited by law.
Right of Withdrawal
Consumers generally have the right to withdraw from an online purchase within 14 days of receiving the goods, subject to the applicable statutory rules and exceptions.
To exercise this right, the customer must communicate a clear statement of withdrawal to us within the applicable period.
Withdrawal requests may be sent to:
Email: promo@swapandfit.com
Company: [XXX Company Legal Name]
Registered Address: [XXX Registered Address, Germany]
The customer should identify the relevant order and clearly state the intention to withdraw from the purchase.
Following withdrawal, the goods must be returned in accordance with the applicable statutory requirements and the instructions provided. Unless we have offered to collect the goods, the customer should send them back within the period prescribed by law.
The customer may be responsible for the direct cost of returning goods where permitted by law and where the required information was provided before the purchase.
Refunds will be processed within the applicable statutory period. Where the law permits, we may withhold reimbursement until we have received the returned goods or evidence that they have been sent back, whichever occurs first.
Where required by law, reimbursement includes the cost of the least expensive standard delivery option offered at the time of purchase. Additional charges for a more expensive delivery option need not be reimbursed where the law permits this.
The right of withdrawal is separate from statutory rights concerning faulty or non-conforming goods.
Damaged, Faulty or Incorrect Goods
If goods arrive damaged, faulty, incomplete or materially different from the purchase description, please contact promo@swapandfit.com.
Please include:
- Your order number.
- A brief description of the issue.
- Clear photographs showing the relevant damage, fault or discrepancy, where applicable.
Photographs may allow us to assess the matter without requiring the goods to be returned in appropriate cases.
Following review, we may arrange a replacement or refund where appropriate. Where a return is required by law or is reasonably necessary to resolve the matter, we will provide relevant instructions in accordance with applicable law.
Customers are not required to accept a photographic assessment as a substitute for any mandatory statutory remedy. Nothing in this section restricts the customer’s rights concerning non-conforming goods under applicable German or European law.
Statutory Rights for Non-Conforming Goods
Goods must conform to the purchase contract and the applicable statutory requirements.
Where goods do not conform, consumers may be entitled to remedies under applicable law, including repair, replacement, price reduction or termination of the contract, depending on the circumstances and the legal requirements.
These remedies are distinct from the 14-day right of withdrawal.
Nothing in these Terms excludes or reduces mandatory statutory rights relating to faulty, damaged or non-conforming goods.
Refunds
Refunds will be issued to the original payment method unless another method is agreed with the customer or required by applicable law.
The timing of a refund depends on the applicable statutory requirements and the circumstances of the request.
Where a refund relates to withdrawal, the statutory rules governing reimbursement and any permitted withholding apply. Where a refund relates to non-delivery or non-conforming goods, the applicable contractual and statutory remedies apply.
We may request order details or reasonable supporting information to identify the transaction and process the request.
Customer Responsibilities
Customers should provide accurate order and contact information, review product details before purchasing and contact us promptly if an issue arises.
Customers should retain relevant order confirmations and correspondence to assist with enquiries.
These responsibilities do not remove any legal obligation imposed on us or limit mandatory consumer rights.
Website Information and Changes
We may update website content to reflect changes to products, prices, availability or business operations.
The terms applicable to an existing purchase are those forming part of the relevant contract, subject to applicable law. Changes to these Terms will not retrospectively alter an existing contract unless permitted by law or agreed where required.
Liability
Nothing in these Terms excludes or restricts liability where such exclusion or restriction is prohibited by applicable law.
In particular, these Terms do not limit mandatory consumer rights or any liability that cannot lawfully be excluded or restricted.
Any other liability will be determined in accordance with the applicable statutory provisions and the circumstances of the case.
Personal Data
Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation.
Information provided when placing an order may be used to administer the purchase, arrange delivery, process payments, respond to enquiries and meet applicable legal obligations.
Applicable Law
These Terms are governed by the law applicable to the relevant purchase, subject to mandatory consumer protection provisions.
Where a consumer habitually resides in another country and applicable law provides protection under mandatory provisions of that country’s law, nothing in these Terms deprives the consumer of that protection.
Any agreement concerning jurisdiction is subject to the mandatory rules governing consumer contracts.
